Documents That Require Witnesses in Arizona
Last Will and Testament
Requires 2 witnesses who are not named in the will, not related to the testator, and not beneficiaries. Witnesses must be present at the same time and sign in front of each other and the testator.
Living Will / Healthcare Directive
Requires either 2 witnesses OR a notary — not both. If using witnesses, they cannot be the patient's healthcare provider, an employee of the provider, or anyone who would inherit from the patient.
General / Durable Power of Attorney
Requires 1 witness who is at arm's length — meaning they cannot be named in the POA, cannot be a beneficiary, and cannot be the agent being appointed.
Medical Power of Attorney
Requires either 1 witness OR a notary — not both. If using a witness, they cannot be the healthcare agent named in the document, a healthcare provider, or an employee of the provider.
